As long as humankind has walked on the earth there have been disputes. When there are disputes, they have to be resolved. This resolution of disputes has led to the evolution of different systems of dispensation of justice. Mediation is an important tool to provide justice to a party Justice itself is a very nebulous concept. The very concept of Mediation evolved simply because the traditional system of delivery of justice was found to be more and more in effective. The traditional system of justice by trial and in Courts were long drawn and in most cases out played by time. Mediation encourages dialogues, reconciliation and healing and neutral agreement in the pursuit of justice. Restorative justice, simply put can be understood to mean justice which restores reconciliation and healing and concentrate on sustaining mutual relationship between the parties.
A developed and culturally mature society should encourage resolution of both civil and criminal disputes through mediation. Mediation is a process which is structured but, which at the same time, does not involve the rigidity inherent in conventional litigation settings, it is in fact a process which has elements of science as well as of an art. Mediation strives to “unite parties riven asunder”.
